Divorce

Finances

Getting a divorce or separating from a partner is relatively simple. But the financial aspects of a relationship breakdown are often complex.

We aim to encourage an early resolution of the financial side of a relationship breakdown. We encourage voluntary disclosure of assets and negotiated settlements; or we will guide you through the court process while still seeking a negotiated settlement.Go to top of page

Children

If a relationship breaks down the children are usually the first concern. And court proceedings are usually the last thing you want to sort out any difficulties.

We have many years’ experience of dealing with issues involving children and we will advise you on the options available. If possible, we will also help you resolve any dispute without recourse to litigation.Go to top of page

Cohabitation Agreements

In English law there is no such thing as a ‘common law marriage’ and couples can live together for many years without either of them acquiring rights over the property or assets of the other. In cases of an unexpected bereavement or relationship breakdown this can lead to complex, expensive and protracted legal proceedings.

Civil Partnerships

The position on the breakdown of a Civil Partnership is very similar to that on a divorce.

Prenuptial Agreements

The courts are now more inclined to regard prenuptial agreements as binding (unless there is a reason not to do so) and they are increasingly common, especially with second marriages.

Collaborative Family Law

Many couples going through a divorce or relationship breakdown want to work out their differences in a constructive way, and negotiate a settlement without protracted court proceedings.

Collaborative family law involves couples sitting down together, with their respective solicitors, and working to find solutions to their problems. Although this approach does not suit everyone, where it is possible it can be the best way of resolving family disputes because it puts the clients firmly in control of the process.
